General Conditions of Sale

Preamble

The online store of the site www.ateliervingtsept.fr was set up by the Atelier 27 department, belonging to the company 27 which is the operator of this site.
Any order placed for a product appearing in the online store of the website www.ateliervingtsept.fr implies prior acceptance of these general conditions.
Consequently, the consumer acknowledges being fully informed of the fact that his agreement concerning the content of these general conditions does not require the handwritten signature of this document, insofar as the customer wishes to order online the products presented in the framework of the website store.
The consumer has the option to save or edit these general conditions, it being specified that both the saving and the edition of this document are his sole responsibility, these general conditions of sale may be subject to modifications. In this case, the applicable conditions will be those in force on the site on the date of the order.

1 / The products

The online store set up by Atelier 27 as part of the website mentions the following information:

• presentation of the essential characteristics of the products offered.
• indication of the terms of payment, delivery, or execution.
• the existence of a right of withdrawal (except for cut-to-size products – See 4/ Right of withdrawal)
• the period of validity of the offer or price.

All of this information is presented in French. The consumer declares that he has full legal capacity to enter into a commitment under these general conditions.

Product characteristics: The products offered for sale are those described on the Site. Atelier 27 takes the greatest care in the presentation and description of these fabrics to best satisfy the Customer's information. In any event, in the event of non-conformity of the product delivered in relation to its description on the Site, the Customer may exercise his right of withdrawal if it is not a cut product.

2 – A / The company Atelier 27 presents on its website www.ateliervingtsept.fr the products for sale with the necessary characteristics which allow compliance with article L 111-1 of the Consumer Code, which provides the possibility for the potential consumer to know before the final order the essential characteristics of the products he wishes to purchase.

2 – C / The products offered comply with European marketing standards. The photographs, texts, graphics, information and characteristics reproduced and illustrating the products presented are not contractual. Consequently, Atelier 27 cannot be held liable in the event of an error or omission in one of these photographs, texts or graphics, information or characteristics of the products.

2 – D / Atelier 27 cannot be held responsible for non-performance of the contract due to any cases of force majeure.

2 – E / Hypertext links may refer to sites other than the site “ateliervingtsept.fr”. Atelier 27 disclaims all liability in the event that the content of these sites contravenes the legal and regulatory provisions in force.

3/ Photos and product visuals

Atelier 27 photos are taken in the studio with compliant lighting and devices. Atelier 27 screens are regularly calibrated. Atelier 27 is not responsible for the display of colors on Internet users' screens, regardless of their quality.

4/ The order

Ordering on the Site is subject to compliance with the procedure set up by the Atelier 27 Company, embodied by a series of different steps that the customer must follow to validate their order. The customer will have the opportunity, before definitively validating their order, to check the details of the order and its total price, and to correct any errors, before confirming it to express their acceptance. Any order confirmed by the Customer constitutes a sales contract and acceptance of all the provisions herein.

Atelier 27 will refuse any order from a customer with whom there is a dispute or incident relating to the payment of a previous order or who contravenes the provisions hereof.

In this case, Atelier 27 will inform the Customer by email. If the customer fails to correct any erroneous elements or those contrary to these general terms and conditions of sale with Atelier 27, Atelier 27 reserves the right not to process the order.

A confirmation email summarizing the order (products, price, product availability, quantity, etc.) will be sent to the customer by Atelier 27. For this purpose, the customer formally accepts the use of email for confirmation by Atelier 27 of the content of his order. Invoices are provided upon delivery.

5/ Right of withdrawal

Atelier 27 respects the legal withdrawal period of 14 working days from the date of delivery to you. During this period, the consumer can return, at his own expense, the products that do not suit him accompanied by the initial invoice. This period runs from the day of delivery of the consumer's order. Any return must be reported in advance to the Customer Service of the company Atelier 27 by an email to the address hello@ateliervingtsept.fr

Exceptions to the right of withdrawal: products cut to size, made to measure, or exclusively. The right of withdrawal therefore does not apply to the sale of fabrics or bias binding by the meter.

If the reason for return is due to an error on our part, we will send you a "colissimo tracking return" label by post. You just need to stick it on the package.

The return costs are the responsibility of the customer but we will not charge you for the shipping costs in the event of an exchange. Atelier 27 recommends that the consumer return their products by registered mail or with additional insurance guaranteeing, where applicable, compensation for the products up to their actual market value in the event of theft or loss of these goods.

This right of withdrawal is exercised without penalty, with the exception of return costs which remain the responsibility of the consumer. The value of the returned items "Exceptions to the right of withdrawal: products cut to size, made to measure, or exclusively" will then be refunded by re-crediting the bank account (secure transaction) in the event of payment by credit card, or by check in other cases (shipping costs not refunded). With the customer's agreement, the value of the return may be re-credited in the form of a credit on the customer's account and will be deducted from the following order(s).

In the event of exercising the right of withdrawal, Atelier 27 will make every effort to reimburse the consumer upon receipt of the goods "Exceptions to the right of withdrawal: products cut to size, made to measure, or exclusively".

6/ Prices and payment terms

6 – A / Price

Product prices are indicated in euros, all taxes included excluding shipping costs. The total price of the order (all taxes and shipping costs included) is indicated in the shopping cart.

Atelier 27 reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in effect at the time the order is registered, subject to availability.

6 – B / Payment terms

The products are payable in cash on the day of the actual order.

Payment for purchases is made either by:

- Bank card The Customer accesses a dedicated space made available by a banking institution, which ensures the security and recording of the payment order. In this regard, the Customer expressly acknowledges that the communication of his bank card number to the Atelier 27 Company constitutes authorization to debit his account for the products ordered.

The data recorded and stored by the Atelier 27 Company constitutes proof of the order and all past transactions. The data recorded by the payment system constitutes proof of financial transactions.

The consumer guarantees the company Atelier 27 that he has the authorizations possibly necessary to use the payment method chosen by him, when validating the order form.
Atelier 27 reserves the right to suspend any order management and delivery in the event of refusal of authorization of payment by bank card by officially accredited organizations or in the event of non-payment.
Atelier 27 reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid for a previous order or with whom a payment dispute is currently being administered.
The consumer remains advised that Atelier 27 cannot be held responsible for any wrongdoing or fraudulent use of any means of payment which has not been detected by the verification procedure.
As part of this verification, the customer may be asked to send a copy of an identity document and proof of address to Atelier 27 by email. The order will only be validated after receipt and verification by our services of the documents sent. If these documents are not received within 15 days of placing the order, the order will be deemed to be automatically cancelled.

Atelier 27 retains full ownership of the products sold until full payment of all sums owed by the consumer in connection with their order, including costs and taxes.

7/ Delivery

The delivery time is estimated on average at 4 working days upon receipt of payment (excluding pre-sales).

Here are the delivery method options for orders on ateliervingtsept.fr:

- Colissimo

The transport methods offered depend on the country of delivery.

Delivery is made to the delivery address indicated by the customer, it being specified that this must be the customer's residential address or that of any other natural person of their choice domiciled in metropolitan France. Delivery cannot be made to hotels or PO boxes.

In order for these deadlines to be respected, the customer must ensure that they have provided accurate and complete information regarding the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.).

The times indicated are indicative times, corresponding to the average processing and delivery times. Atelier 27 cannot be held responsible for the consequences due to a delay in delivery that is not its fault.

In the event of damaged packages (already opened, missing products, etc.), the Customer undertakes to notify the carrier and the Atelier 27 Company, by any means, of any reservations within 3 days of receipt of the product.

7/ Applicable law

Any order automatically implies the customer's acceptance of the general terms and conditions of sale. These general terms and conditions of sale are governed by French law. In the event of a dispute, only the French courts will have jurisdiction. In the event of a difficulty or complaint regarding an order, the customer can contact Customer Service to find an amicable solution.

8/ Information technology and freedoms

The information collected by the Atelier 27 Company during a customer order is necessary for the management of the transaction and for this purpose may be communicated in whole or in part to the service providers of the Atelier 27 Company involved in the execution of the order. The customer is informed that this same personal data may also be collected by an organization responsible for analyzing orders and combating bank card fraud. In accordance with the Data Protection Act No. 78-17 of January 6, 1978, the customer has the right to access, rectify, oppose and delete data concerning him/her.
